These Terms & Conditions apply to fiction feedback and related services provided by A.M. Rodgers Fiction Services.
By engaging A.M. Rodgers Fiction Services for a service, you agree to these Terms & Conditions.
1. Services
A.M. Rodgers Fiction Services provides fiction feedback services including:
Beta Reading
First Chapter Feedback
Manuscript & Story Feedback
other fiction feedback services agreed with the client
The specific service, scope of work and price will be discussed and agreed with the client before payment is made and work begins.
2. What the services provide
The purpose of the services is to provide an author's reader-focused perspective and constructive feedback on their writing.
Depending on the service selected, feedback may consider areas such as:
plot and structure
pacing
character development
story arcs
engagement
clarity
voice and tone
the overall reading experience
areas that may be strengthened
Feedback is intended to provide useful observations and suggestions.
The client remains responsible for deciding which feedback, suggestions or changes they wish to adopt.
A.M. Rodgers Fiction Services does not guarantee publication, representation, commercial success, sales, reviews, awards or any other particular outcome from the feedback provided.
3. Manuscript submission
Clients will generally provide manuscripts and other writing materials by email.
The client is responsible for ensuring that they have the right to provide the material for review.
Manuscripts should be submitted in an agreed file format and in accordance with any instructions provided before work begins.
4. Pricing and payment
Prices displayed on the website are starting prices or standard prices where indicated.
The final price may vary depending on factors including:
the service selected
manuscript length
the scope of feedback requested
additional requirements agreed between the client and A.M. Rodgers Fiction Services
The final price will be agreed with the client before payment is made and work begins.
Payment instructions will be provided following confirmation of the service.
Work will generally commence once payment has been received, unless another arrangement has been agreed in writing.
5. Turnaround times
Turnaround times will vary depending on:
the service selected
manuscript length
the amount of feedback required
current availability
A timeframe will be discussed and agreed with the client before payment is made and work begins.
If circumstances arise that are likely to significantly affect an agreed timeframe, the client will be contacted as soon as reasonably practicable.
6. Confidentiality
A.M. Rodgers Fiction Services understands that manuscripts are personal and valuable creative work.
Client manuscripts and project information will be treated as confidential.
Manuscripts and other materials provided for a service will not intentionally be shared with or disclosed to third parties without the client's permission, except where necessary to provide the agreed service, required by law, or necessary to protect the rights or safety of A.M. Rodgers Fiction Services or another person.
7. Intellectual property
The client retains ownership and copyright of their manuscript and other original materials they provide.
Providing a manuscript to A.M. Rodgers Fiction Services does not transfer ownership or copyright.
Any feedback, written report or other original material created by A.M. Rodgers Fiction Services for the client remains the intellectual property of A.M. Rodgers Fiction Services unless otherwise agreed.
The client may use the feedback and report for the purpose of developing their own manuscript.
A.M. Rodgers Fiction Services will not publish, reproduce or publicly share a client's manuscript without the client's permission.
8. Client responsibilities
The client is responsible for:
providing accurate information about their project
providing the correct manuscript or materials for review
ensuring they have the necessary rights to submit the material
communicating any particular questions or areas they would like feedback on before work begins
providing materials in an agreed format
If a client provides incomplete or incorrect materials, this may affect the agreed timeframe.
9. Cancellations and refunds
If a client needs to cancel a service, they should contact A.M. Rodgers Fiction Services as soon as possible.
Where work has not yet commenced, a cancellation and refund may be considered depending on the circumstances.
Where work has already commenced, the amount of any refund will depend on the circumstances and the amount of work already completed.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded under the Australian Consumer Law.
10. Australian Consumer Law
A.M. Rodgers Fiction Services provides services in accordance with applicable Australian Consumer Law requirements.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with the service, you may have the right to cancel your service contract and receive a refund for the unused portion, or compensation for its reduced value.
You may also be entitled to compensation for reasonably foreseeable loss or damage resulting from a failure to meet a consumer guarantee.
For a problem that is not a major failure, you may be entitled to have the problem rectified within a reasonable time.
Nothing in these Terms & Conditions is intended to remove or limit rights that cannot legally be excluded under Australian law.
11. Nature of feedback
Feedback is provided from the perspective of an author and avid fiction reader.
Feedback represents professional observations and opinions based on the material provided.
Different readers may respond differently to a story, and the client remains responsible for decisions about their manuscript.
The service does not constitute legal, publishing, literary-agent, financial or other specialist professional advice.
12. Right to decline a project
A.M. Rodgers Fiction Services reserves the right to decline a project before work begins.
This may include circumstances where the requested work falls outside the services offered, the project is unsuitable for the service, or the required timeframe cannot reasonably be accommodated.
If payment has already been made and the project is declined before work begins, the payment will be refunded.
13. Privacy
Personal information and manuscript materials are handled in accordance with the A.M. Rodgers Fiction Services Privacy Policy.
The Privacy Policy explains how personal information is collected, used, stored and protected.
14. Changes to these Terms & Conditions
These Terms & Conditions may be updated from time to time.
The version published on this website will be the current version.
Changes will not retrospectively alter the terms that were agreed for a service that has already commenced unless required by law.
15. Governing law
These Terms & Conditions are governed by the laws applicable in Victoria, Australia.
Any disputes will be dealt with in accordance with applicable Australian law.
